Terms of Service

About these terms

These terms apply when you use SkyScribe: the app at skyscribe.app and the sites it hosts at <name>.skyscribe.site (together, the “Service”). SkyScribe is provided by Perpetual Summer Ltd (“we”, “us”, “our”), a company registered in England and Wales (company number 11246803) whose registered office is Piccadilly Business Centre Unit C, Aldow Enterprise Park, Manchester, M12 6AE.

By signing in or using the Service you agree to these terms, to our Acceptable Use Policy, and to how we handle personal data as described in our Privacy Policy. If you don’t agree, please don’t use the Service.

Your account

• You sign in with your Bluesky account. We never see your Bluesky password. You’re responsible for keeping that account secure and for everything done through it on SkyScribe.
• You must be at least 16 years old to use the Service.
• If you use SkyScribe on behalf of an organisation, you confirm you have its authority to accept these terms for it.

The Service

Anyone with a Bluesky account can use SkyScribe’s writing and design tools for free, including saving up to three site designs. A paid subscription, SkyScribe PRO, adds hosted sites on skyscribe.site (one per Site Slot you pay for), the Image Library, and unlimited saved designs. The current features and prices are shown on the Subscribe page before you buy.

We’re continually developing SkyScribe, so features may change. If we remove something central to a paid subscription, we’ll tell you in advance.

Subscriptions and payment

• Who sells it. Subscriptions are sold through Stripe Managed Payments. Stripe acts as the merchant of record: it takes your payment, handles sales tax or VAT, and issues your receipts, under Stripe’s terms. We provide the Service you’ve paid for.
• Renewal. A subscription renews automatically at the end of each billing period, at the price you agreed to, until it is cancelled. If we change the price, we’ll tell you before it applies to your next renewal, and you can cancel before then.
• Site Slots. Your subscription is priced per Site Slot. Adding a Site Slot changes what you pay from then on.
• Cancelling. You can cancel at any time by emailing hello@skyscribe.app. Your PRO features and hosted sites stay available until the end of the period you’ve already paid for.
• Failed payments. If a renewal payment fails, your sites stay live while the payment is retried. If it still hasn’t succeeded after about ten days, the subscription ends.
• When a subscription ends, your hosted sites are paused: visitors see a notice that the site isn’t available, and PRO features stop. Your content stays in your Bluesky account.
• Refunds. Refund requests are handled through Stripe as merchant of record. If you’re a consumer, you have legal rights in relation to digital services that aren’t as described or not of satisfactory quality, and nothing in these terms affects them.

Your content

• You own it. The Documents and Publications you write are stored in your own Bluesky repository, not with us. Images you upload to the Image Library are stored by us on your behalf.
• What you let us do with it. You give us a worldwide, non-exclusive, royalty-free licence to store, copy, process, display and publish your content, only as needed to run the Service: for example, to show it in the editor, render it on your hosted sites, generate preview screenshots of your designs, and serve your images. The licence ends when you remove the content from the Service, except where we have to keep something for legal reasons.
• Published means public. What you publish to a hosted site, and your Bluesky records, can be seen by anyone.
• Your responsibility. You’re responsible for what you publish and upload, and you confirm you have the rights to it. It must follow our Acceptable Use Policy.

Hosted sites and subdomains

You choose your site’s subdomain when you launch it, and you can change it later. A subdomain is part of the Service, not something you own. We may refuse or reclaim a subdomain that impersonates someone, infringes someone’s rights, misleads visitors, or is otherwise inappropriate. We’ll give you notice where we reasonably can.

Suspension and termination

We may remove content, pause a hosted site, or suspend or close an account if it breaks these terms or the Acceptable Use Policy, if we must by law, or to protect the Service or other people. Where appropriate and lawful we’ll tell you why and give you a chance to put things right first. We may act without notice for serious breaches, including illegal content.

You can stop using SkyScribe at any time. To have your data deleted, see the Privacy Policy.

Our intellectual property

The SkyScribe software, name, logo and site templates belong to Perpetual Summer Ltd or our licensors. You may use them only as part of using the Service. Sites you build with our templates are yours to publish on SkyScribe.

Other services

SkyScribe relies on services we don’t control, including Bluesky and the AT Protocol network (your account and content), and Stripe (payments). Their own terms apply to your use of them, and we’re not responsible for their availability or conduct.

Availability

We work to keep SkyScribe and hosted sites available and secure, but we can’t promise the Service will always be uninterrupted or error-free. We may need to take it offline for maintenance, updates or reasons outside our control.

Our liability to you

• Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can’t be limited by law, and nothing affects your statutory rights as a consumer.
• We aren’t responsible for losses that weren’t foreseeable, or that result from your breach of these terms, from events outside our reasonable control, or from services we don’t operate (such as Bluesky, your Personal Data Server, or Stripe).
• If you use the Service for business purposes, we aren’t liable for loss of profit, revenue, business, or data, and our total liability to you is limited to the amount you paid us for the Service in the 12 months before the claim arose.

Changes to these terms

We may update these terms, for example when the Service or the law changes. We’ll change the “Last updated” date above, and for significant changes we’ll let you know before they take effect. If you don’t agree, you can stop using the Service and cancel any subscription before the changes apply.

Law and disputes

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you’re a consumer living elsewhere, you keep the protection of the mandatory consumer laws where you live, and you may also bring proceedings in your local courts.
